TERMS OF USE & CONDITIONS ---------- TURNAROUND TIMES ARE NOT GUARANTEED We have never had an issue with turn around time in the past, however in the off chance that unforeseen circumstances arise (example: equipment failure, product shipment, etc.) that prevent us from delivering your product by your requested date, Platt’s Printing and Travis Platt Enterprises will not be held liable for the delay. ---------- COLORS ARE NOT GUARANTEED Because of limitations with our printing process, as well as neighboring image ink requirements the accuracy of color reproduction is not guaranteed and by placing an order with us you agree to this limitation. We accept no responsibility for color variations between the on screen images, proof prints, and the final printed piece. Under no circumstances will a refund or reprint be honored for color variations that have occurred during the printing process. ---------- CUTTING & SIZE LIMITATIONS Because of limitations with our printing process, the accuracy of cutting is not guaranteed and by placing an order with us you agree to this limitation. All jobs are printed at the size that is ordered, but they are cut inside slightly to avoid excess from the job next to it. We accept no responsibility for size variations below or above 1/16" to 1/8". The cuts can also slide up, down, left, or right 1/16" to 1/8" in either direction. Under no circumstances will a refund or reprint be honored for cutting or size variations that have occurred during the printing process within these specifications. ---------- QUANTITY VARIATIONS Most of the time we will print slightly more than what you ordered, for no additional charge. As printing industry trade standards allow for underages of up to 10%, sometimes we will print slightly fewer pieces than you ordered. If you are doing a mailing and need to receive the exact amount ordered, it is best to communicate this to someone in our production department at the time you place your order. Under no circumstances will a refund or reprint be honored for a quantity that was shorted less than 10%. ---------- COPY & DESIGN ERRORS We have provided an proof with this agreement for you to look over, spell check, and make sure it is EXACTLY what you want printed. We we will not take responsibility for any copy or design errors after you have signed your name on our final proof page. We are also not responsible for any wrong dates or misspelled words in jobs approved by customer upon design completion. Under no circumstances will a refund or reprint be honored for an error in the file submitted or the design that was approved. ---------- REFUND POLICY: Cancellations: A "Cancellation" occurs when the Customer or Supplier voids an order for a withdrawal of funds from a Customer's Card account or bank account before a sale is sent for deposit. PlattsPrinting.com will not collect a deposit from the Customer and the previously authorized funds will be released at the Card issuing bank's discretion. After a sale is sent for deposit, any attempt to reimburse the cost of a Product to a Customer constitutes a Refund and shall be dealt with as set forth below. You may contact us regarding your purchase from PlattsPrinting.com within 2 days of delivery for a full refund. Returns: A return occurs when a Customer returns Products previously purchased from 2CO ("Return"). PlattsPrinting.com will not reduce the amount of a Refund by the assessment of a "restocking fee" or any other charge (including shipping charges) for any Return that occurs in accordance with PlattsPrinting.com's Return Policy. Refunds: A refund is the actual reimbursement of the cost of a Product to a Customer("Refund"). PlattsPrinting.com accomplishes the Refund by reversing the amount previously charged to the Customer's Card or account at the Card issuing bank and the appropriate amount is credited to the appropriate Card or account at the Card issuing bank of Customer. ---------- NATIONWIDE SHIPPING We will not be responsible for shipping delays or lost shipments caused by third party shipping companies. Under no circumstances will a refund or reprint be honored for a shipping delay or lost shipment. ---------- Services and Conditions of Use As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as 'customer' in this agreement ---------- Indemnification The customer will indemnify and hold harmless the printer, Platt’s Printing, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted against the printer on the grounds alleging that said printing violates any copyright or any proprietary right of any person. You certify that you own the rights to use the image(s) being reproduced on your order. ---------- Right to Subcontract Platt’s Printing shall have the right to assign any portion of the work required to another contractor. ---------- Sample Use Platt’s Printing may use your product for samples or advertising purposes. ---------- Limitation Of Liability And Warranty CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER'S OWN RISK. SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ---------- THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER. ---------- NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
